Commercial Use Policy TORC ROBOTICS TRUCKDRIVE DATASET Version 1.0 — Effective May 1, 2026 This document provides a plain-language guide to the definition of Commercial Use in LICENSE-NONCOMMERCIAL.txt (the "License"). It is incorporated into and forms part of the License. In the event of any conflict between this document and LICENSE-NONCOMMERCIAL.txt, the License controls. The Core Question Ask yourself: Is this Dataset being used, directly or indirectly, to build, improve, or support anything that generates or is intended to generate revenue or competitive advantage? If yes, it is almost certainly Commercial Use and requires a commercial license. Clearly Non-Commercial (No Commercial License Required) Academic research at non-profit universities and institutions A PhD student or faculty researcher using the Dataset to publish a paper on perception algorithms, even if the paper is later cited by industry, is Non-Commercial Use. This applies even if the researcher is employed part-time at a company, as long as the Dataset is not used in that commercial capacity. Benchmarking for research publication Use of the Dataset to perform benchmarking for the purposes of academic or applied research publication is Non-Commercial Use, provided that the benchmarking results are not used to develop, train, validate, or improve a commercial product or service. Evaluating model performance on TruckDrive and publishing those results in a conference paper or journal article is Non-Commercial Use, regardless of whether the publishing party is an academic institution or a commercial entity. Use of the same benchmarking results to guide internal product development is Commercial Use, regardless of whether a paper is also published. Government research Use by federal, state, or local government agencies or government- funded national laboratories for governmental, non-commercial purposes is permitted. Personal and hobbyist use An individual learning computer vision or robotics for personal development, with no intent to commercialize the output, is Non-Commercial Use. Journalism and public interest research A journalist or non-profit organization using the Dataset to analyze and publish findings about autonomous vehicle safety, with no commercial product incorporating the Dataset, is Non-Commercial Use. Teaching Use in university coursework or educational materials, where students are not commercializing outputs, is Non-Commercial Use. Clearly Commercial (Commercial License Required) Autonomous vehicle companies Any company whose business involves developing, testing, or selling autonomous or semi-autonomous vehicle systems, driver-assistance technology, robotics, or related perception or planning software must obtain a commercial license. This applies to internal R&D use, even if no product directly incorporates the Dataset. Training commercial models Using the Dataset to train, fine-tune, or validate a machine learning model that is then deployed in a commercial product or service requires a commercial license, regardless of whether the Dataset itself is distributed. Startups and spinouts A startup founded to commercialize research, even if not yet generating revenue, is engaged in Commercial Use if the Dataset informs product development. Contractors and consultants If You are working on behalf of a commercial entity and using the Dataset in that engagement, Your use is Commercial Use even if you personally are an academic or independent researcher. Benchmark and evaluation services Using the Dataset as part of a paid benchmarking, evaluation, or data labeling service is Commercial Use. Internal use at technology companies A software or technology company using the Dataset for internal purposes, even if those purposes are described as "research," is engaged in Commercial Use if the company's business is commercial in nature and the use relates to that business. Gray Areas and How We Handle Them Pre-competitive consortia Use of the Dataset in a multi-party research consortium depends on the consortium's structure and outputs. Contact us before proceeding. Open-source projects Publishing code or models trained on the Dataset as open source does not, by itself, make the use non-commercial. If the open-source project is backed by or intended to support a commercial entity, a commercial license is required. Government contractors Private companies operating as government contractors should contact us. Whether their use is commercial depends on the nature of the contract and the use of outputs. When in Doubt If You are uncertain whether Your use is Commercial Use, do not proceed without first contacting us. We will respond promptly and, where use is genuinely ambiguous, will work to find an appropriate path forward. Contact: licensing@torc.ai Proceeding with use that turns out to be Commercial Use without a license is a material breach of the License and may result in termination of Your rights and legal liability. Policy Versioning This policy is versioned alongside the Dataset. If You downloaded the Dataset under a prior version of this policy, the version in effect at the time of Your download governs Your use, except that the Licensor may require You to comply with updated terms upon notice if a new version materially changes the commercial definition. Versions are tracked in the repository's git history. Copyright (c) 2026 Torc Robotics, Inc. All rights reserved.
